Long-awaited reform of immigration law begins

The Polish Governance regulations are not the only significant changes concerning employees. In the shadow of the tax reform, work on amending the Act of the 12th of December 2013 on foreigners and certain other acts has come to an end. The new provisions will enter into force on the 29th of January 2022. 

The amendment is an attempt to respond to the growing needs of the labour market related, among others, to labour shortages and the unabated inflow of foreigners to Poland. Some procedures are to be simplified. Among the changes are the rules for issuing work permits, including declarations on the employment assignment, temporary residence and work permits and the Blue Card. The assumption is that employing a foreigner will become easier and faster, and the employee will gain more freedom in taking up a new job.  

In addition to the benefits, the guarantee of a minimum wage for persons staying in Poland on the basis of uniform permits, regardless of the full-time employment, may prove to be a challenge. Employers are faced with the dilemma of the obligation to equalise the remuneration of part-time workers.
