The employer may set the vacation leave plan on its own if employees do not submit their proposed vacation leave dates by the specified deadline | PRO HR February 2023

2023.02.20

In many companies the first weeks of the year are the time of vacation planning. Vacation leaves can be planned in two ways: by setting up a vacation plan or by agreement with the employee (if the company does not have a vacation plan in place).

In both cases, the employer is obliged to take into account the requests of employees regarding their preferred vacation dates and, on the other hand, the need to organize work in such a way as to ensure the normal course of work. The final decision on whether to grant leave to an employee is up to the employer.

Sometimes employees procrastinate in proposing the vacation dates by the set deadline, which disorganizes the whole process. Employee passivity should not block the employer. In this case, the employer can set the vacation schedule on its own, taking into account the needs of the company and the vacation plans of the employees who have submitted their proposed vacation dates. The plan thus established may be supplemented or adjusted during the year in special situations.
