December marks the deadline for completing medical certificates whose validity has been extended under the "covid act" | PRO HR 2023

During the outbreak of the covid epidemic, the obligation to perform periodic examinations of employees was suspended. At the same time, the validity of the preventive examinations performed (preliminary, periodic, check-up) and the medical certificates issued on their basis, which expired after 7 March 2020, was extended. These certificates remained valid, but no longer than until the expiration of 180 days from the date of abolishing the state of epidemiological threat or the state of epidemic.

The revocation of the state of epidemic threat, effective 1 July 2023, reinstated the suspended obligations. In practice, this means that employers must refer employees whose medical certificates have been extended (under Article 31m sec. 1 of the so-called covid act) for examinations confirming their ability to work no later than 28 December 2023. This leaves little time left to obtain new medical certificates. 

Allowing an employee to work without a valid examination is an offense.
