This results from the fact that according to §3 of the Regulation on Employee Records, an employee's personnel file consists of 5 parts and includes parts A, B, C, D and E.

The regulations do not provide for exceptions in this regard, so even if the employer has not introduced sobriety checks, it should add Part E to the file. When conducting an inspection, the State Labour Inspection Service draws attention to this and calls for establishing the missing part of the file.
