If an employee files a lawsuit with the labour court, regardless of the amount of his or her claim, he or she will not pay a lawsuit fee.

Under current regulations, an employee does not pay a lawsuit fee (or an appeal or complaint fee) only in cases where the value of his or her claim does not exceed the amount of PLN 50,000.

If the employee claims a higher amount, he or she is obliged to pay a court fee equal to 5% of the value of the subject of the dispute (appeal).

After the amendment of the regulations, an employee will not have to pay a lawsuit fee at all, even if the value of the dispute exceeds PLN 50,000.

Instead, a fee will be charged to the employee if he or she files an appeal, but only on the amount exceeding PLN 50,000.

The new regulations are expected to take effect two weeks after they are promulgated.
