An employee seconded to work in Poland must undergo mandatory medical examination and OSH training unless he/she has undergone examination and training in his/her home country that meets Polish requirements | PRO HR April

2022.04.14

In the event of an inspection, the State Labour Inspection Service (PIP) will request documentation to verify whether the documents presented from the seconding state are in compliance with Polish regulations.

Preventive medical check-ups are carried out in Poland on the basis of a referral, in which the employer indicates not only the employee's work position but also information on the presence of hazardous or harmful to health factors, onerous factors or other factors resulting from the way the work method.

An employer who seconds an employee to Poland should therefore demonstrate that any medical certificate from the seconding country was issued on the basis of a referral containing the same data as the data that would have been included in a Polish referral for examination of an employee in the same position.

Polish regulations specify the minimum number of hours of initial training and its curriculum.

Therefore, an employer who seconds an employee to Poland must demonstrate that the initial training program that the employee completed in another country is consistent with the requirements of Polish law. Moreover, according to PIP, the position training should be conducted at the position where the employee will actually perform work. Consequently, the training should take place only in the country to which the employee is seconded.
