Employers often wonder what information they can ask about during recruitment process. Meanwhile not all personal data are of the same category.

An employer may request some of them unconditionally and some only when it is necessary to perform work of a certain type of or at a certain position.

Some data may be processed only as an exception (if such an obligation results from the provisions of law) or solely with the candidate’s consent or on his own initiative.

The employer must remember the basic principles of personal data processing when obtaining information and documents from the candidates.

In practice, the period of storing the personal data of job candidates also raises doubts. The employers choose different solutions, even though the Personal Data Protection Office (UODO) is quite strict in this regard.
