Limitation of employee claims under the employment relationship | PRO HR Press

2020.11.12

Most of the employee's claims against the employer are statute-barred – after a certain period of time, the employer may evade the employee's claim. Usually it will be 3 years.

The limitation periods for claims are specified in generally applicable laws. The employment agreement (or other agreement concluded with the employee) cannot specify a different length of these periods. Such a provision of the agreement will be invalid.

More in the article Piotr Lewandowski and Agnieszka Piasecka, "Employee claims will expire at different times" for Rzeczpospolita (article from 12 November 2020).
