The employer should verify the legality of foreigners’ stay and work | PRO HR June 2021

2021.06.07

Solutions facilitating the retention of legal stay and work of foreigners were introduced in connection with the pandemic. Validity dates were extended for work permits, statements on entrusting of performance of work, temporary residence permits and national visas which expired during the pandemic.

However, the fiction of the validity of permits will cease to apply. The documents will be valid 30 days of the date of lifting of the state of epidemic or state of epidemic emergency, whichever falls later. This means that foreigners who until now have worked and stayed in the country on the basis of the documents with extended validity will lose the basis for both their legal stay and work.

Employers must ensure that new documents are obtained.

Entities employing foreigners without relevant work permits or employing foreigners who stay in Poland illegally may face negative consequences.
