Uncertain fate of the bill on remote work regulations | PRO HR July 2021

All three nationwide trade union organizations gave a negative opinion on the bill on remote work regulations.

Issues related to occupational safety and health, employers incurring the costs of remote work and the option to introduce remote work on a permanent basis or incidentally continue to generate emotion. Trade unions are also not fond of the option for employers to enact remote work regulations unilaterally if they fail to strike an agreement with the trade union organizations (even though a similar regulation has been in force to date in respect of telework).

Discussions regarding this bill have been in progress for a year. It seemed that publishing the bill in the Government Legislation Centre (https://legislacja.rcl.gov.pl/projekt/12346911) portended the rapid wrap up of the work and that the rules for doing remote work that has proven itself in many companies during the pandemic would be regulated on a permanent basis.

On 22 June, an arrangement conference was held as part of the interdepartmental consultation on the bill. The findings gathered at the conference will be used in the work on a new wording of the bill which will be subject to further consultations.
