Work during COVID self-isolation to be made possible | PRO HR December 2020

Currently the employer may not admit to work an employee who is incapable to perform it due to illness.

If it fails to observe this restriction, it is subject to liability for an offence. If an employee performs work during an illness they lose the right to benefits for the entire period when they are ill.

Such rules apply also in the case of an employee subject to self-isolation, which is required of persons diagnosed with Covid-19. This means that such persons are unable to work due to illness.

However, a lot of people are asymptomatic and retain the full capacity to work.

The legislator has discerned the problem and proposed changes which will enable employees self-isolating at home to perform work. Such persons will be able to perform remote work with the employer’s consent. The substantiation of the bill stipulates that in the case of deterioration of the health condition the employee will become entitled to a sickness benefit.
