Although trade unions abuse their right to initiate an collective dispute, they must be approached with caution. Failure to comply with an employer's obligations in relation to a dispute is a criminal offence. The obligations include notifying the district labour inspector about the start of the dispute, participating in negotiations, signing an agreement or a protocol of differences or bearing the costs of mediation. An employer or a person acting on his behalf who fails to fulfil these obligations or otherwise interferes with the conduct of the dispute may pay up to 1 million PLN in fines.
