Judgment of the District Court in Olsztyn of 29 January 2021, case file IV Pa 79/20

An employer may request private information, e.g. employee’s travel destination if its purpose is to protect employees against Covid. An employer may dismiss an employee for cause for refusing to provide that information or for providing untrue information. The general welfare takes primacy over an employee’s privacy. The rules for protecting the staff against Covid empowering an employer to take such actions should be set forth in special rules and regulations.

The ruling is discussed by Bartłomiej Raczkowski.
