Decision #4 | What HR must know and apply in practice

2021.04.22

Supreme Court judgment of 23 January 2020, case file II PK 228/18

An employee cannot be expected to foresee an impediment to work and prepare a report on the work done in advance. The employer should make provision for procedures in the event of an employee's absence to ensure organisational continuity. It is the employer who is required to be foresighted.

The employee is not liable for damage occurring after the work has been completed.

The ruling is discussed by Janusz Tomczak.
