PRO HR Cafe | Constant changes in the employment of foreigners - challenges for HR departments

Recent weeks have seen the announcement of many changes in HR law. The novelties will also concern the legality of the stay and performance of work by foreigners, in particular citizens of Ukraine who entered Poland due to the war. 

The provisions on extending the validity of documents from the Covid Law will disappear, which for some foreigners may mean that there is no basis for further stay in the Republic of Poland. The government is also backing away, at the last minute, from provisions allowing Ukrainian citizens an almost unconditional right to apply for a temporary residence permit. The law will not enter into force before January 2023, which poses a dilemma as to whether it is worth submitting residence applications for those who have already acquired such rights after all. The regulation of work and residence for Russian citizens is being further tightened. 

We will talk about the challenges in the area of global mobility: 

  • New regulations and solutions that affect employers
  • Further status of Ukrainian workers in Poland 
  • Repeal of regulations extending legal residence and work in connection with the so-called "covid fiction"
  • Changes concerning Russian citizens

Michał specialises in all aspects of employing foreigners in Poland, including implementing the most effective practices. In addition, he advises on the international mobility of employees, complex issues related to corporate immigration at all stages of people planning and hiring, as well as the posting of workers to provide services abroad.

His expertise covers all cross-border HR aspects. He supports clients in coordinating and implementing all of their national and international HR requirements.

He is an author of many publications and comments in scientific journals and newspapers. Michał is a member of The American Immigration Lawyers Association (AILA) and the American Bar Association.
