Health and Safety (OHS) in Remote Work

Employers are obliged to provide employees working remotely with safe and hygienic working conditions. Given the specific nature of remote work, especially the lack of full control over the workplace, the employer is relieved from certain OHS duties as outlined in the Labour Code:

  • Appointing an OHS coordinator
  • Organising the workplace in accordance with OHS regulations
  • Ensuring the safe and hygienic state of work premises and technical equipment, and maintaining and using collective protection measures properly
  • Ensuring that the premises where work is performed meet OHS standards
  • Providing employees with preventive meals, drinks, and hygienic-sanitary devices

 

However, additional informational and training obligations have been imposed on employers to ensure the safety and hygiene of remote work:

  • Updating the occupational risk assessment to include the effects of remote work on eyesight, musculoskeletal system and psychosocial conditions
  • Preparing information regarding the proper organisation of the workplace, including ergonomic requirements, safe and hygienic work practices, actions to take after completing work and emergency procedures for situations that are threatening to health or life
  • Obtaining declarations from employees confirming they are familiar with the risk assessment and the aforementioned information
  • Obtaining declarations from employee confirming that safe and hygienic working conditions are ensured at the location agreed upon by the employer and employee
  • Providing necessary training and technical support
  • Supplying materials, tools and technical devices required for remote work, including installation, service and maintenance costs

 

Employers are also granted the authority to control and verify the employee’s compliance with OHS regulations during remote work.

Such control should:

  • Be conducted in agreement with the employee during working hours
  • Not violate the privacy of the employee or others
  • Not interfere with the domestic use of the premises in accordance with their intended purpose

If the employer identifies violations of OHS regulations, they have the right to ask the employee to rectify the issues, or may revoke the permission to work remotely.
