Therefore not, as is commonly reported, on 1 January 2026.<\/p>\n<p>Employees employed on the day when the provisions enter into force will have <strong>24 months<\/strong> in which to provide documents confirming earlier periods of activity. Periods not documented within this time will not be included in calculations regarding the length of total employment.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Periods included in employment tenure<\/strong><\/p>\n<table>\n<thead>\n<tr>\n<td><strong>Type of period<\/strong><\/td>\n<td><strong>Conditions for inclusion<\/strong><\/td>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td>Non-agricultural self-employment<\/td>\n<td>Pension, disability or accident insurance contributions must have been paid<\/td>\n<\/tr>\n<tr>\n<td>Cooperation in running a business (e.g. spouse)<\/td>\n<td>Same requirement \u00a0contributions must have been paid<\/td>\n<\/tr>\n<tr>\n<td>Civil law contracts (mandate, service, agency)<\/td>\n<td>Periods when the person was covered by pension and disability insurance<\/td>\n<\/tr>\n<tr>\n<td>A person cooperating under a civil law contract<\/td>\n<td>Same \u2013 if covered \u00a0by pension and disability insurance<\/td>\n<\/tr>\n<tr>\n<td>Civil law contracts for students\/pupils under 26<\/td>\n<td>No obligation for social insurance \u2013 such periods may be included, but the employee must provide proof of work<\/td>\n<\/tr>\n<tr>\n<td>Start-up relief (business without ZUS contributions for six months)<\/td>\n<td>Included despite lack of mandatory contributions<\/td>\n<\/tr>\n<tr>\n<td>Suspension of business activity to care for a child<\/td>\n<td>Included if the pension and disability contributions were paid<\/td>\n<\/tr>\n<tr>\n<td>Gainful employment abroad<\/td>\n<td>Documented period of work; no restriction to specific contributions and any reliable document may serve as proof<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<p><strong>What about annual leave in the year the act enters into force?<\/strong><\/p>\n<p>Example \u2013 if the act entered into force on 1 March 2026:<\/p>\n<ul>\n<li>Until February 2026, the employee had 9 years of tenure, entitling them to 20 days\u2019 leave.<\/li>\n<li>In March 2026, the added periods raise their total duration of employment above 10 years, entitling them to 26 days\u2019 leave.<\/li>\n<\/ul>\n<p>In that case, the employee does not automatically receive the full 26 days from January; only from the date of the act entering into force is leave calculated proportionally.<\/p>\n<p><strong>There will be minor exceptions to including these non-employment periods.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Find more articles in\u00a0<a href=\"https:\/\/raczkowski.eu\/en\/pro-hr-august2025\/\">PRO HR August 2025<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The bill amending the Labour Code has already reached the next stage of parliamentary work.
