As a rule, this system is used only in specific situations where the nature of work makes it impossible to precisely determine start and end times. However, it is not an unlimited working time system \u2013 the employer must still observe working time standards, i.e. 8 hours per day and 40 hours per week.<\/p>\n<ol>\n<li data-start=\"636\" data-end=\"927\"><strong data-start=\"636\" data-end=\"655\">Who can use it? <\/strong>The system is intended for positions where controlling working time is difficult, such as programmers, postal workers, or designers. It cannot be applied to employees who require strict time supervision, such as machine operators, cashiers, or public transport drivers.<\/li>\n<li data-start=\"636\" data-end=\"927\"><strong data-start=\"929\" data-end=\"961\">Agreement with the employee. <\/strong>The employer determines the time needed to complete tasks in consultation with the employee. Ultimately, however, it is the employer who bears responsibility for setting this time appropriately.<\/li>\n<li data-start=\"636\" data-end=\"927\"><strong data-start=\"1160\" data-end=\"1186\">Tasks to be completed. <\/strong>Tasks should be clearly defined, specific, and arise from the employment contract or job description. A general job description containing open-ended duties does not meet this requirement.<\/li>\n<li data-start=\"636\" data-end=\"927\"><strong data-start=\"1379\" data-end=\"1404\">Working time records. <\/strong>The employer must keep records of working time, although start and end times do not need to be registered \u2013 except in the case of overtime.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h5 data-start=\"1548\" data-end=\"1583\"><\/h5>\n<h5 data-start=\"1548\" data-end=\"1583\"><strong data-start=\"1552\" data-end=\"1583\">Risks and potential claims:<\/strong><\/h5>\n<ul>\n<li data-start=\"1585\" data-end=\"1785\"><strong data-start=\"1585\" data-end=\"1598\">Overtime.<\/strong><br data-start=\"1598\" data-end=\"1601\" \/>The employer is obliged to pay for overtime if the tasks assigned cannot objectively be completed within standard working hours. However, overtime work requires the employer\u2019s consent.<\/li>\n<li data-start=\"1585\" data-end=\"1785\"><strong data-start=\"1787\" data-end=\"1815\">Improper implementation.<br \/>\n<\/strong>If the task-based system is introduced incorrectly, the employee may claim, for example, overtime pay or recognition that they worked under the standard working time system.<\/li>\n<li data-start=\"1585\" data-end=\"1785\"><strong data-start=\"1993\" data-end=\"2008\">Night work.<br \/>\n<\/strong>A night work allowance is due only if such work results from the employer\u2019s instruction or the nature of the work itself, not if it arises solely from the employee\u2019s choice.<\/li>\n<\/ul>\n<p data-start=\"2186\" data-end=\"2463\">The task-based system can benefit both parties by providing greater organisational flexibility.
