The Ministry of Health has outlined the assumptions for a bill that will allow employers to obtain information about employee vaccinations.

The Ministry of Health has outlined the assumptions for a bill that will allow employers to obtain information about employee vaccinations.

According to the provisions, if it turns out that an employee is not vaccinated, does not have the status of a recovered person or does not have a valid negative test result for SARS-CoV-2, the employer will be able to delegate such a person to work outside his/her permanent place of work or to another type of work, even if this would result in a reduction in pay, or to take an unpaid leave.

The employer will be also able to require vaccination information from job applicants.

The proposed legislation has long been expected by employers. If they enter into force, employers will have a specific legal basis for processing employee vaccination data, which is a special data category under the GDPR.

However, it is still not certain when the bill will be submitted to the Parliament (Sejm).
